Other replies also report first-run success, so NG+ and Kindness 3 are not established universal requirements. Suggestions about hidden attributes remain speculation, not a confirmed witness-selection formula.

Before retrying the trial

Keep a save before the trial if possible. Record the witness, dialogue choices and verdict together; changing all of them after a rewind makes it hard to identify what mattered. If the scene stops advancing, use the patch check below. A frozen scene and an unfavourable verdict are different problems, and neither establishes that the prison route is available from your current state.

Patch 1.1.1 fixes one trial soft lock

The official patch fixes a case where Omni-Forward stopped progress when Chester was a witness during Epicrates's trial. Update and reload from before the trial if that happened. The fix confirms a broken interaction, not the complete trial-winning or recruitment route.
